The Herban Bud Basics

Order right here on our website for legal cannabis products delivered straight to your front door. Our products are also available in hundreds of stores and dispensaries across the United States. No, we do not sell marijuana, but we do sell legal cannabis.

Cannabis is the name of a single plant that is split into two classifications:

1) Marijuana
2) Hemp

Marijuana remains illegal at the federal level, and is legal in certain states for recreational and/or medicinal use. Marijuana is defined as any cannabis plant with a concentration of higher than 0.3% THC on a dry weight basis.

Hemp-derived products were removed from the Control Substances Act with the passage of the 2018 Farm Bill. This makes hemp federally legal, with additional regulations implemented on a state-by-state basis. Hemp is defined as any cannabis plant with a concentration of “not more than 0.3 percent [THC] on a dry weight basis.”

So in short: both marijuana and hemp come from the exact same plant. The only difference is the percentage of Delta-9 THC present in the plant.

Our products have been carefully formulated to provide similar effects to the marijuana products you would find in a legal market like California or Colorado, using only legal cannabis. These include various hemp-derived cannabinoids like Delta-8 THC, Delta-9 THC, HHC, and THC-O.

Some people will swear that the feeling they get from Delta-8 THC, HHC, and THCp is the same as what they experience from cannabis. Some will beg to differ. Only you can make that determination for yourself. We’re pretty convinced over here that they’re almost identical!

Delta-8 THC is roughly 60% the strength of Delta-9 THC (aka marijuana), so we’ve increased the strength of our Delta-8 products so the dosages will roughly line up with what you can purchase in regulated states like Colorado or Nevada. For example, one of our 15mg Delta-8 gummies would equate to a 9mg Delta-9 gummy. In regulated markets, gummies often come in 10mg increments.

We get this question a lot.

Delta-8 THC and Delta-9 THC are both broken down into a compound called 11-hydroxy-THC (people are calling this Delta-11) when your body metabolizes them. This specific compound is responsible for the relief many people experience from medical and recreational cannabis products.

Because Delta 8 converts into the same compound as Delta 9 THC, yes, you get largely the same effects as marijuana. Some people will swear it’s the same, and some people will beg to differ. The only products we don’t make ourselves are products from Cali Green Gold and The Remedy. We have an exclusive distribution deal with these companies to only make D8 products for Herban because we couldn’t possibly make a better product. If that’s ever the case in the future, we’ll add more products from third parties, but for now it’s only those two companies because everything else is manufactured by us in either our Los Angeles, California facility or our Austin, Texas facility.

Yes, you sure can, all 50 states! You can even bring them to a state that doesn’t allow the sale of D8 because you’ve already purchased it legally in a state we ship to.

You absolutely can be arrested for having these products on you because they look, smell, and smoke like marijuana products. Please save the packaging or the COA from our website so you don’t get arrested by an over zealous police officer.

COA stands for “certificate of analysis” and it shows to law enforcement, or anyone else for that matter, that what you have in your possession is derived from 100% federally legal hemp and is legal for sale. You can also scan the QR code on any item of ours to pull up the COA to show anyone or even just look for yourself. These are the lab results that come from DEA registered labs.

At present, we cannot and will not ship D8 to the following states: Alaska, Arkansas, Arizona, Colorado, Delaware, Idaho, Iowa, Mississippi, New York, North Dakota, Montana, Nebraska, Rhode Island, Utah, Washington. No state has yet passed a law prohibiting the sale of THCO, however, so you’re free to order that if you live in any of the above states.

If you consume any Delta 8 products you wil definitely fail your UA because of the above question. The UA is screened for 11-hydroxy THC, not Delta 9 THC. THCO is still new and untested in regards to failing a UA for THC being present, so please be careful. On the positive side, we’ve been hearing a lot of people getting waivers from their jobs because D8 is sold legally in so many states. It’s best to check with your job or probation / parole officer before you partake.

COA stands for “certificate of analysis.” These documents show the lab results on our products from Drug Enforcement Agency-registered labs. The purpose of the COA is to prove that what you have in your possession is derived from 100% federally legal hemp. You can show the COA to law enforcement to prove that our products contain only hemp-derived ingredients and federally-compliant amounts of THC.

Legal Questions

As long as you’re traveling to and from states where the products are legal, you can travel with hemp-derived cannabis products. (See below for a list of states where Delta-8 is not legal).

What about flying with Herban Bud products? The TSA website states: “Marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent [Delta-9] THC on a dry weight basis.

“TSA’s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.”

In short—Herban Bud products are federally legal, so they are TSA compliant. But keep that COA nearby so you can prove it!

It is very likely that you will fail a drug test if you consume Herban Bud products.

A urinalysis screens for 11-hydroxy-THC, which is produced when your body metabolizes Delta-8 or Delta-9 products, whether they came from legal hemp or illegal marijuana.

The results of HHC and THC-O on drug tests are speculative, but they may also lead to the failure of a drug test.

On the positive side, we’ve heard of many people getting waivers from their jobs, since Delta-8 is sold legally in so many states. It’s best to check with your job or probation/parole officer before you partake in any cannabis products.

Science Stuff

Delta-9 THC is the major cannabinoid present in the marijuana plant. It’s considered to be the primary active component of the plant, leading to the high in full-spectrum marijuana.

The 2018 Farm Bill requires that legal hemp plants contain less than 0.3% Delta-9 THC by dry weight. Similarly, gummies and other edibles must contain less than Delta-9 THC by dry weight, which is why we are able to sell Delta-9 gummies at Herban Bud.

Delta-8 is a naturally-occurring cannabinoid, similar to Delta-9 THC. This compound is roughly 60% the strength of Delta-9 THC, and is said to produce similar effects. We offer Delta-8 products in a variety of strengths, so you can achieve the dosage you’re looking for.

HHC (short for hexahydacannabinol) is a naturally-occurring, hemp-derived cannabinoid with an additional hydrogen molecule. It is roughly 80% the strength of Delta-9 THC, and is said to provide a similar effect.

THC-O is an isomer of Delta-9 THC. This cannabinoid has a higher bioavailability than conventional THC. That means it can be absorbed into the body at a higher level and deliver a more potent experience.

Some outlets have reported that THC-O is significantly more potent, psychoactive, and euphoric than Delta-9 THC. Plus, it may provide a 4 to 6 hour high, rather than a 2 hour high from Delta-9.

THCp (short for tetrahydrocannabiphorol) is a natural cannabinoid that bonds extremely effectively with the user’s cannabinoid receptors. This improved bond leads to a physical effect 33-times stronger than Delta-9 THC, according to an Italian study.
