Smoke shops, head shops, and CBD outlets across the country are selling a wide variety of products containing delta 8 THC, the hemp-derived compound that was considered federally legal under the terms of the 2018 farm bill.
Unlike CBD, delta 8 THC is intoxicating. It’s a naturally occurring cannabinoid commonly derived from hemp-sourced CBD. Its distillate is normally infused into edibles or sprayed onto hemp flower, which allows it to be smoked the same way as regular cannabis.
There is a lot of marketing and enthusiasm around buying delta 8 but – outside of regulated stores – there are no other regulations to ensure product potency and purity. There are no rules from stopping the bad actors.

Rule #2: Know how to spot fake brands
Some shops operating outside of state-licensed cannabis systems are selling packages of vape carts and delta 8 gummies that look errily similar to the illicit-market vape carts that sickened thousands of Americans with the vape lung disease known as EVALI in 2019.
Avoid falling for fake brands and copycat packaging. We already see products attempting to look like larger cannabis companies with logos that are meant to mimic the originals.
Rule #3: Buy directly from the maker online
If you are not able to purchase from a state-licensed cannabis store, buying online can be a simple way to know you’re about to buy delta 8 products without sketchy payment. You want to do your research into the brand that you are choosing to purchase from, check out client reviews, and contact the company with any questions you may have.
When you purchase online, you can buy from a respected retailer or directly from the product manufacturer. Legitimate brands will have lab results available, guarantee that their products do not contain toxins, and offer a high-quality experience.
Rule #4: Avoid sites that use cash app payments
How do you know you’re ordering from a legit source online? One clue is their payment system. Do not purchase from sites that ask you to purchase via Cash App, Venmo, or Paypal.
Since CBD is federally legal – and delta 8 THC is derived from CBD, online retailers have the ability to work with legitimate payment processors, unlike most dispensaries that are licensed cannabis industry.
